Procedure for submitting applications for invention and utility model to the Department of Technical Information of Kherson State Maritime Academy:

These Rules are developed in accordance with the Law of Ukraine "On Protection of Rights to Inventions and Utility Models" (3637-12) (hereinafter - the Law), the Paris Convention for the Protection of Industrial Property of March 20, 1883 (995 123) that is in force in Ukraine of December 25, 1991, the Patent Cooperation Agreement signed on June 19, 1970 that is in force in Ukraine of December 25, 1991, and determine the requirements for such documents as the application for invention (secret invention) and application for utility model (secret utility model)

Legal protection is granted to an invention (utility model) that does not contradict public order, humanity and morality principles and meets the conditions of patentability defined by Article 7 of the Law.

The invention meets the condition of patentability, if it is new, has an inventive step and is industrially applicable.

The composition of the application:

  • Description of the invention (utility model);
  • Claims of the invention (utility model);
  • Drawings (if they are referenced in the description);
  • Abstract.

1. Registration of the application documents:

1.1. The application documents, namely: the patent application, the description and claims of the invention (utility model), the drawings and the abstract are to be submitted in triplicate. Documents that require further translation may be submitted in the original language in one copy, and their translation - in triplicate.

1.2. All documents of the application for an invention (utility model) should be executed so that they may be stored for a long time and directly reproduced in an unlimited number of copies.

2. Application documents are to be printed on white paper sheets of 210 x 297 mm format.

Begin each application document on a separate sheet; enumerate the second and subsequent sheets in Arabic numbers. Use each sheet on one side only, with the rows arranged parallel to the smaller side of the sheet.)

The minimum size of the margins of the sheets containing description, claims and abstract is as follows, mm:

- left - 25;

- top - 20;

- right and bottom - 20.

Drawings are to be performed on white paper sheets of 210 x 297 mm format. The minimum size of the margins of the sheets containing drawings is as follows, mm:

- left - 25;

- top - 25;

- right - 10;

- bottom - 15.

2.1. All documents should be printed in black. The text of the description, claims of the invention (utility model) and abstract are to be printed at 2 or 1.5 intervals provided the height of letters in computer typing is at least 2.1 mm (according to Order of the Ministry of Education and Science № 154 (z0332-04) dd. 26.02.2004).

2.2. It is allowed to write in Latin names, Latin and Greek letters, graphic symbols, mathematical and chemical formulas in black ink.

2.3. Bibliographic data of information sources in the application documents should be presented so that this information source can be found.

2.4. Graphic images

2.4.1. Graphic images (drawings, schemes, diagrams) should be performed according to the rules of drawing, on thick, white, smooth paper with black clear lines and strokes that may not be erased, without shading and coloring.

2.4.2. Choose the scale and sharpness of the images so that when reproducing them with a linear reduction in size to 2/3, one can distinguish all the details.

The height of numbers and letters must be at least 3.2 mm. Numeric and letter designations must be clear, the thickness of their lines must correspond to that of the image lines. Numbers and letters should not be enclosed in parentheses or quotation marks.

2.4.3. In the drawings use mainly rectangular (orthogonal) projections (in different types, sections and crosscuts); in some cases the use of axonometric projection is also allowed. Each element in the drawing should be performed pro rata with all other elements, except when a clear image of the element requires a distinction of proportions.

2.4.4. Dimensions in the drawings should not be indicated, they are to be given in the description, if necessary. Perform drawings without any inscriptions, except for the necessary words, such as "water", "steam", "open", "closed", "section for A-A".

2.4.5. Place the separate figures so that the sheets are filled as much as possible and the drawings can be read in the vertical arrangement of the longer sides of the sheet. If the figures placed on two or more sheets are part of a single drawing, place them so that this drawing can be composed without omitting any of the figures depicted on different sheets. Several figures can be placed on one sheet of the drawing, and they should be clearly separated from each other.

2.4.6. The elements of the figures are denoted by Arabic numbers according to the references to them in the description of the invention (utility model). The same elements in several figures should be denoted by the same numbers. The designations not mentioned in the description of the invention (utility model) should not be put down in the drawings and vice versa (according to Order of the Ministry of Education and Science № 154 '(z0332-04) dd. 26.02.2004)

2.4.7. If the graphic images are presented in the form of a scheme, then standard conventional designations should be used in its execution. If the scheme is presented in the form of rectangles as graphic symbols of the elements, then, in addition to the digital symbol, enter the name of the element directly in the rectangle, if possible. If the size of the graphic image of the element does not allow to do it, then the name of the element can be specified on the extension line (if necessary, in the form of an inscription under this element). On schemes of one kind it is allowed to place the image of separate elements of schemes of other kind (for example, on the electric scheme the image of elements of kinematic, hydraulic schemes, etc. is allowed).

2.4.8. Each graphic image is to be numbered sequentially in Arabic numerals (Fig. 1, Fig. 2, etc.) regardless of the type of this image (drawing, scheme, diagram, etc.) and numbering of sheets in the order they are presented in the text of the description. If the description of the invention (utility model) is interpreted with one graphic image only, it should have no numbering (according to Order of the Ministry of Education and Science № 154 (z0332-04) dd. 26.02.2004)

2.5. Chemical formulas

It is possible to use chemical formulas in the application documents. Structural formulas of chemical compounds are to be presented (as well as drawings) with the numbering of each structural formula as a separate figure and references to the relevant designations. When writing structural chemical formulas, apply commonly used symbols of the elements and clearly indicate the links between elements and radicals.

2.6. Mathematical formulas and symbols

It is possible to use mathematical expressions (formulas) and symbols in the description, claims and abstract of the invention (utility model). The form of presentation of a mathematical expression is not regulated. All letter designations in mathematical formulas must be deciphered. The decipherment of letter designations should be given in the order of their use in the formula.

To indicate the intervals between values, the use of the sign «-» (from and to) is allowed; in other cases write words «from» and «to». When expressing values in percent, place the percentage sign (%) after the number. If there are several values, place the percentage sign in front of their list and separate from them by a colon. Mathematical notations «>», «

Hyphenation in mathematical formulas is allowed only by sign. Write the explanation for the mathematical formula in column and put a semicolon after each line.

2.7. The requirements for executing the application documents set out in the Rules should be also applied to any materials submitted after the submission of the application, for example, to the pages containing corrections and to the amended clauses of the claims of the invention (utility model) (according to the Order of the Ministry of Education and Science № 154 (z0332-04) dd. 26.02.2004)
